Terms of Service

1. Acceptance of Terms

By accessing or using Web Agent Bridge ("WAB", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms are governed by Dutch law and the applicable laws of the European Union, including the Digital Services Act (DSA) and consumer protection regulations.

2. Definitions

• "Service" — The WAB hosted platform at webagentbridge.com, including the API, dashboard, and bridge script delivery
• "Software" — The open-source WAB codebase, licensed under the MIT License
• "User" / "You" — Any person or entity using the Service
• "Site Owner" — A User who embeds the WAB bridge script on their website
• "Agent Developer" — A User who builds AI agents that interact with WAB-enabled websites
• "Subscription" — A paid plan (Starter, Pro, or Enterprise) with additional features

3. Open Source License

The WAB software is released under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, subject to the conditions of the MIT License.

These Terms of Service apply specifically to the hosted service at webagentbridge.com. If you self-host WAB, the MIT License governs the software, and you are responsible for your own terms and compliance.

4. Accounts

4.1 Registration

To use certain features, you must create an account with a valid email address and secure password. You are responsible for maintaining the confidentiality of your credentials.

4.2 Age Requirement

You must be at least 16 years of age to use the Service, in accordance with the Dutch UAVG implementation of GDPR Art. 8.

4.3 Account Security

You are responsible for all activity under your account. Notify us immediately at support@webagentbridge.com if you suspect unauthorized access.

5. Service Tiers & Subscriptions

5.1 Free Tier

WAB offers a free tier with core features: auto-discovery, click/scroll/form-fill permissions, and basic logging. The free tier is provided "as-is" without guaranteed uptime or support.

5.2 Paid Subscriptions

Paid plans (Starter, Pro, Enterprise) provide additional features including:

• Analytics dashboard
• API access and data extraction
• Custom rate limits and webhooks
• Priority support

5.3 Billing

Subscriptions are billed monthly or annually via Stripe. Prices are displayed in EUR and are inclusive of Dutch VAT (BTW) for EU consumers, or exclusive of VAT for business customers with a valid EU VAT number.

5.4 Cancellation & Refunds

You may cancel your subscription at any time from your dashboard. Per the EU Consumer Rights Directive (2011/83/EU):

• You have a 14-day cooling-off period from the date of purchase for a full refund
• After 14 days, your subscription continues until the end of the current billing period
• No refunds for partial billing periods after the cooling-off period

6. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable law or regulation
• Scrape, harvest, or collect data from websites without authorization
• Use Stealth Mode to bypass security controls on websites you do not own or have authorization to test
• Distribute malware, spam, or malicious content through the bridge
• Attempt to gain unauthorized access to our systems or other users' accounts
• Circumvent rate limits or abuse the Service infrastructure
• Use the Service for any purpose that violates the rights of others

Violation of these terms may result in immediate account suspension or termination.

7. Site Owner Responsibilities

If you embed the WAB bridge script on your website, you are responsible for:

• Informing your website visitors that AI agent interaction is enabled (transparency requirement)
• Configuring appropriate permissions and restrictions for your site
• Ensuring your use of WAB complies with applicable laws, including GDPR, ePrivacy, and accessibility regulations
• Obtaining necessary consents from your users where required

8. Intellectual Property

The WAB software code is open source under the MIT License. However, the following are proprietary and may not be used without permission:

• The WAB brand name, logo, and visual identity
• The webagentbridge.com hosted service infrastructure
• Proprietary documentation and marketing content

9. Service Availability

We aim to provide high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control (force majeure).

10. Limitation of Liability

To the maximum extent permitted by applicable law, including Dutch Civil Code (Burgerlijk Wetboek):

• The Service is provided "as-is" and "as-available"
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages

Note: These limitations do not affect your statutory rights as an EU consumer under the Consumer Rights Directive or the Dutch Burgerlijk Wetboek.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the dashboard and API will be revoked
• Your license keys will stop working
• You may request export of your data within 30 days (per GDPR Art. 20)
• We will delete your personal data within 30 days, except where retention is required by law

12. Dispute Resolution

These Terms are governed by Dutch law. Any dispute arising from these Terms shall be submitted to the competent court in The Hague, the Netherlands.

For EU consumers: You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/odr.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
